Applicable Law

These terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

Sales Terms & Conditions

General

We are Pen & Sword Books Limited ("Pen & Sword Books/Us/We/Ours") of 47 Church Street, Barnsley, S70 2AS.

These are the Terms and Conditions on which we offer, sell and supply any of our goods. Please read these terms carefully before you complete your order.

By submitting an order, you are accepting the Terms and Conditions of the Pen & Sword Books website, these Terms and Conditions of Supply, our Privacy Policy and Cookies Policy.

Your Details

When you register with the Pen & Sword Books web site, you will be required to choose a contact email address and password. You are responsible for all sessions and transactions taken under these details. You should keep your password safe and not disclose it to anyone. You should change it immediately if you feel it has been compromised. You confirm that you are over 18 and that all information you provide to us is true.

The Contract Between Us

  1. Any contract for purchases made through the web site will be with Pen & Sword Books Limited, registered in England, and whose registered office is 47 Church Street, Barnsley, South Yorkshire, S70 2AS, company registration number 2527258.
  2. Pen & Sword Books Ltd must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Once payment has been received Pen & Sword Books will confirm that your order has been received by sending an email to you at the email address you provide in your registration form.
  3. Any order you make represents an offer to us to purchase a product that is accepted by us when we send email confirmation to you that we have dispatched the product to you. The dispatch email will include your name, the order number and the total price. Pen & Sword Books acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract. Any products on the same order which we have not confirmed in a dispatch confirmation email to have been dispatched do not form part of that contract but form a subsequent contract when the dispatch email in respect of those goods is sent.
  4. Pen & Sword Books are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our web site. If an error or inaccuracy is discovered with regards to the advertised price of the goods or otherwise that you have ordered we will contact you as soon as possible by email.
  5. Products may vary slightly from their pictures. The images of the products on the website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products.

Availability Of Goods You Order

If Pen & Sword Books has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by Pen & Sword Books from your credit card will be re-credited to your account and Pen & Sword Books will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. Pen & Sword Books will not be obliged to offer any additional compensation for disappointment suffered.

PLEASE NOTE: We endeavour to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our web site as quickly as we can to minimise disappointment. The process of updating the web site when goods have sold out at campaign price can take a few hours to update. Please note that the price the goods are offered for tender are as displayed in the Shopping Basket.

Delivery of Goods to You

  1. Pen & Sword Books will post, or arrange a courier on your behalf for, the goods ordered by you to the person and address you give Pen & Sword Books at the time you make your order. The costs of delivery are as displayed on the website.
  2. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of despatch of the order. All delivery times quoted on the web site are estimates only, based on availability, normal processing and delivery companies.
  3. You will become the owner of the goods you have ordered when the goods are dispatched to you from our premises in Barnsley.
  4. Please check your local tax rules for importation of goods, as you will be liable for any additional tax charges where these apply and Pen & Sword Books has no control over additional charges that may be imposed in relation to customs or other clearance.

Returns Policy

  1. Damaged or mis-printed books - We will gladly replace these books without charge to you. Please contact us within 72 hours of delivery and we will discuss the process for return.
  2. Books sent in error (i.e. picking errors) - We will replace these books and provide a freepost address for you to return the unwanted book.
  3. If the book is unwanted or ordered in error, you can return the book within 14 days of the delivery of your order. You must cover the cost of return postage. Refunds will be made only on the price of the book, less any postage costs incurred by us. If the book is ordered as part of an offer (e.g. 5 for 4) the refund will reflect that the offer is no longer applicable and a refund will be issued after recalculating the cost of the remaining ordered books less any postage costs incurred by us. The returned book must be in mint/resalable condition and accompanied by a copy of the delivery note or receipt. Returns are made at your own risk and so we recommend you obtain a receipt or record for the return of the item.

Digital Products

Digital Products (electronic books, downloadable audiobook or similar application) are subject to the following additional usage rules (the Usage Rules).

  • You can use the Digital Product for personal, non-commercial use only. All digital content is licensed, not sold. You are granted a non-transferable, non-exclusive license to access and use the content for personal, non-commercial purposes.
  • You can store Digital Products on your personal computer, eBook reader, tablet or smartphone.
  • We recommend that you download content to your personal device in order to access offline.
  • Detailed instructions on how to access Digital Products can be found in eBook and audiobook instruction pages.
  • Any exporting capabilities are solely for your personal use and shall not constitute a grant or waiver (or other limitation or implication) of any rights of the copyright owners in any text, audio or video content, sound recording, underlying musical composition, or artwork embodied in any Digital Product.
  • The delivery of Digital Products does not transfer to you any commercial or promotional use rights in the Digital Products.
  • You cannot copy any Digital Products for the purposes of socially or commercially distributing such copies to another device or online, or publicly display any content without prior written consent
  • All Digital Products sold through our website are accessed via Script Books Glassboxx application and are subject to the terms set out on the reader site, which allows you to use such Digital Products and restricts the ability to copy, paste and print. By purchasing or accessing digital content via our website, you agree to use the Glassboxx app to access your purchases. Glassboxx is responsible for the delivery and management of your digital content. By using our services, you also agree to comply with Glassboxx's T&Cs. Please note that by checking out when purchasing your digital content you agree your email address will be shared with Glassboxx and used to create an account with Glassboxx to deliver the eBook/audiobook.
  • You agree that you will not attempt to, or encourage or assist any other person to, circumvent or modify any security technology or software that is part of a Digital Product.
  • Digital Products may not be copied, adapted, translated, made available, distributed, varied, modified, disassembled, decompiled, reverse engineered or combined with any other software, save to the extent that applicable law expressly mandates such a right which cannot legally be excluded by contract.
  • Except to the extent expressly provided by us in writing, Digital Products are provided 'as is' without any warranties, terms or conditions as to quality, fitness for purpose, performance or correspondence with description and we do not offer any warranties or guarantees in relation to Digital Product installation, configuration or error/defect correction.
  • Use of the Digital Products requires one or more compatible devices, Internet access (fees may apply), and certain software (fees may apply), and may require obtaining updates or upgrades from time to time. Because use of the Digital Products involves hardware, software, and Internet access, your ability to use the Digital Products may be affected by the performance of these factors. High speed Internet access is strongly recommended. You acknowledge and agree that such system requirements, which may be changed from time to time, are your responsibility.
  • We are not responsible for any loss or damage resulting from the use of Glassboxx, including but not limited to data loss, service interruptions, or content access issues. Our liability is limited to the amount paid for the affected content.
  • All payments are processed securely. Refunds are not available once digital content has been purchased, except where required by law.
  • Please note: once a digital product (eBook or audiobook) has been purchased, you will no longer be entitled to a refund on that title if you should wish to change your mind.
  • From time to time, we may be required to update Digital Products, for example to implement technical adjustments or to address a security threat. Accordingly, you acknowledge that you may no longer be able to use the Digital Products to the same extent as prior to such change and that we shall have no liability in such case. For this reason, we recommend you archive one copy of each Digital Product you purchase on a secure device.
  • We reserve the right to suspend or terminate access to digital content if you breach these terms or misuse the service. Glassboxx may also enforce its own terms independently.

Liability

This is as follows:

  1. If the goods Pen & Sword Books delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Pen & Sword Books shall have no liability to you unless you notify Pen & Sword Books in writing at the Pen & Sword Books contact address of the problem within 10 working days of the delivery of goods in question.
  2. If you do not receive goods ordered by you within 30 days of the date on which they were dispatched to you, Pen & Sword Books shall have no liability to you unless you notify Pen & Sword Books in writing at the Pen & Sword Books contact address of the problem within 40 days of the date on which the goods were dispatched to you.
  3. If you notify a problem to Pen & Sword Books under this condition, Pen & Sword Books' only obligation will be, at its option: - to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective or to refund to you the amount paid by you for the goods in question to the original method of payment.
  4. If you refuse or fail to take delivery of goods, any risk of loss or damage shall nonetheless pass to you, and without prejudice to any other rights or remedies we have, you shall remain liable for payment in full for the goods.
  5. Pen & Sword Books will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Pen & Sword Books under these terms and Pen & Sword Books shall have no liability to pay any compensation other than a refund to you of the amount paid by you for the goods in question.
  6. Our total liability to you shall not exceed the total of the amount paid by you, if any, for accessing the website, purchasing the products and/or using the services provided by the website.
  7. Nothing in these provisions is intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
  8. Nothing in these terms creates any right which is enforceable by any person who is not a party to the contract.

Disclaimer

Pen and Sword Books makes no representations or warranties about the accuracy, completeness or suitability for any purpose of the information contained in this site or any of the products of whatever nature.

All products are ordered subject to availability and prices quoted are subject to change.

Although we use security software, the security of information and payments transmitted via the internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by means of email or other internet link shall be borne by such user and in no event shall any such losses be borne by Pen and Sword Books.

Force Majeure

Pen & Sword Books shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Entire Agreement

These terms and conditions, together with the current Pen & Sword Books Website prices, Website terms and conditions, Privacy Policy, Cookies Policy and delivery details and Pen & Sword Books contact details, set out the whole of our agreement relating to the supply of the goods to you by Pen & Sword Books. These terms and conditions cannot be varied except in writing signed by a director of Pen & Sword Books. In particular nothing said by any sales person on behalf of Pen & Sword Books should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by Pen & Sword Books. Pen & Sword Books shall have no liability for any such representation being untrue or misleading.

If any part of these terms and conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these terms and conditions will not be affected. If any invalid, unenforceable or illegal provision of these terms would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

Interpretation

In these terms and conditions:

'Pen & Sword Books' and "we" means Pen & Sword Books, 47 Church Street, Barnsley, South Yorkshire, S70 2AS, any connected organisation that actually supplies goods ordered by you and any successor to its business;

'working day' means every day of a calendar year apart from weekends and statutory and public holidays;

'us' means 'Pen & Sword Books' and you together; and

'you' and 'your' means the person ordering goods under these terms and conditions.

Trade Customers

Please note these prices and provisions are for consumers only. Additional discounts on website prices are not guaranteed for trade/resale customers. For trade/resale prices and conditions please call 01226 734222.

Multi-buy Offers

Prices may exclude postage and packing. Promotions apply to listed titles only, which are subject to change and availability. If you choose to purchase a product from a multi-buy offer, but do not purchase enough products to qualify for the special discount, the product will be charged at the normal price. Please note that on 5 for 4 promotions (and other multi-buy offers), the lowest priced title will always be the 'free' item. Some items including those distributed by Script Publishing Services may be excluded from offers.

Promotional Discount Codes

We may occasionally offer discount codes to customers.

Discount codes are exclusive of online postage and packaging and can in some instances only be used once per person with one discount code to be used per transaction. Discount codes cannot be used with any other voucher, coupon or offer. Discount codes can only be used at time of purchase and not retrospectively. We reserve the right to withdraw codes at any time. Some items including those distributed by Script Publishing Services may be excluded from offers.

Competitions

Website and catalogue competition terms and conditions

  1. Competitions are open to all UK residents over the age specified within the competition text.
  2. Employees of the Pen and Sword and associated companies, the prize provider and their immediate families and agents may not enter.
  3. Entry into any competition does not give rise to any binding agreement between the parties.
  4. Competition entries must be made in the manner and by the closing date specified on the competition notice. Failure to do so will disqualify the entry.
  5. Unless otherwise stated, there is no limit on the number of competition entries that can be received from an individual.
  6. There is no purchase requirement to enter a competition.
  7. Where entries are made via a coupon or form it is not acceptable to submit photocopies. Photocopies will be void.
  8. Proof of posting cannot be accepted as proof of delivery.
  9. We cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside our control.
  10. Incomplete or indecipherable entries will be void.
  11. The winner(s) may be notified by telephone, text or e-mail and the results may be published on this website.
  12. We reserve the right to report details of competition winners, to take photographs (or other visual media) and to publish such media.
  13. The judges' decision will be final and no correspondence will be entered into.

Prizes

  1. All prizes are subject to availability and, should any prize be unavailable, no liability will attach to Pen and Sword.
  2. The prize must be taken as offered and no cash alternative will be offered.
  3. When prizes are supplied by third parties we are acting as their agents and as such we exclude all liability for loss or damage you may suffer as a result of any competition.
  4. Entrants should note that unless stated otherwise by us, we do not accept responsibility for the return of any Competition entries, including those consisting of artistic or other material, and may dispose of entries at our discretion.

You will be deemed to have accepted all Terms and Conditions and to agree to be bound by them by entering a competition.
